	The PADI instructor will certainly be sued and should be... Janet - Instructor/CPA August 29, 2007 at 11:40:36 CDNN's news report quotes the PADI instructor who said the child might have run out of air. But in a beginner's scuba diving course, the instructor is solely responsible for preventing that from happening.  I do not know exactly what "guarded condition" means but its clear the child almost died and was seriously injured. The instructor will certainly be sued for gross negligence and should be.  There can be no excuse for allowing a beginner to run out of air. Post a follow-up to this message CDNN HEADLINE NEWS
