Dive operators are very reluctant to cancel trips due to weather. Last year I lost 1300$ on a trip to Cozumel because I wouldn't risk going during a possible hurricane. The tour operator was going to go no matter what (unless grounded by the FAA).  Otherwise, they would have had to give refunds. The tragedy in Belize was clearly due to the fact that Peter Hughes didn't want to refund any money.  They were willing to take what they viewed as a "small risk". What kind of dive vacation did they think they were going to deliver even if the boat didn't sink?  The seas would have been so churned up that the diving would have been bad for days. They should have cancelled the trip even if they thought the danger wasn't severe.  Peter Hughes gambled and lost--he should pay big.
