I filed a brief on behalf of NASCAR in the Supreme Court case and was quoted in the news article. If you are a dive boat operator, own a dive shop, an instructor or give diving tours, you probably (and should) use waiver and release agreements to limit your liability. With this new case it is highly likely that your agreement is now subject to legal challenge and may be entirely void, exposing you and your operations to great risk from lawsuits. You need to have your release agreements reviewed and updated immediately.
